What Is A Section 38 Agreement

Non classé / No Comment / 15 avril 2021

When a developer builds a new road in Nottinghamshire, they make an agreement with us. This is part of Section 38 of Highway 1980. Copies of the above agreements are managed by LGSS Law (Northamptonshire Highways` legal service providers). Section 38 is often agreed with Section 278 when the highway authority takes over the maintenance and maintenance of the road in accordance with the agreement provided for in point 38. This date will be decided by the agreement. Copies of the Section 38 agreements are available from the relevant regional authority of the Land. For agreements in Nottingham City, please contact Nottingham City Council. Once a new road has been built to our standards under Section 38, it is generally publicly maintained. When we receive an application, we will verify that we identify the legal agreements relating to the property and inform you of the cost of making those copies available. Please note that due to major projects related to the legal agreement, it is generally not possible to provide copies of these documents electronically. Visit the site in Section 38 of the agreement to learn more. The submission checklist explains what a developer/advisor must submit for Hampshire County Council to conduct an S38 design review of the developer`s proposals.

The portal guides the applicant through the submission and explains what information is needed. The checklist provides more information about the exact information and documents. Before entering into an agreement, the developer must have obtained the building permit, including permission for all reserved questions. The building permit will generally include an indicative ordinance of the roads to be adopted. A developer may complete the construction of a road and then propose to the Highway Authority in accordance with Section 37 of the Highways Act 1980, but the S38 is more desirable because the Commission does not have the authority to insist that a road meet an authorized standard or that it is then proposed for adoption.
